Terms of Service

1. Acceptance of Terms

By installing or using Frost (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Infinitlab ("we," "our," or "us").

2. Description of Service

Frost is a GitHub App that provides incident-aware merge protection for software repositories. The Service includes:

  • Incident-driven protection triggered by connected incident management providers (PagerDuty, incident.io, generic webhooks)
  • Scheduled protection windows for holidays, launches, and other planned periods
  • Daily recurring protection windows for off-hours and weekends
  • Override labels with full audit trail for emergency merges
  • Slack notifications for protection state changes
  • Audit logs of protection events and overrides

3. GitHub Integration

The Service integrates with GitHub and requires installation as a GitHub App. By using Frost, you also agree to comply with GitHub's Terms of Service and Acceptable Use Policies. We are not responsible for any changes to the GitHub platform that may affect the Service.

4. Plans and Billing

Frost is offered through GitHub Marketplace under multiple plans. Billing for paid plans is handled by GitHub. By subscribing to a paid plan, you also agree to GitHub's billing terms.

  • Plan features and limits are described on frostcode.io and on the GitHub Marketplace listing.
  • Free plans have no billing obligation.
  • Paid subscriptions automatically renew until cancelled. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled per GitHub Marketplace policy. We do not directly process payments and cannot issue refunds outside of that policy.
  • Plan tier changes (upgrades or downgrades) take effect according to GitHub Marketplace's billing rules.

5. User Responsibilities

You agree to:

  • Provide accurate information when using the Service
  • Maintain the security of your GitHub account
  • Use the Service only for lawful purposes
  • Comply with all applicable laws and regulations
  • Not attempt to circumvent any security or access controls in the Service
  • Not use the Service to interfere with others' use of their repositories or with the GitHub platform

6. Acceptable Use

The Service is intended for legitimate merge protection during incidents and risk periods. You may not:

  • Use protection mechanisms to suppress legitimate code review or block colleagues from contributing
  • Use override labels to bypass protection for purposes other than genuine emergencies
  • Reverse engineer, scrape, or attempt to derive the Service's source code
  • Use the Service to send spam, phishing, or malicious content via notification channels
  • Resell or sublicense the Service without our written permission

7. Service Availability

We strive for high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, third-party outages (GitHub, PagerDuty, incident.io, Slack, hosting providers), or events outside our control. We are not liable for damages resulting from service interruptions.

You acknowledge that Frost is a tool for merge protection. The ultimate responsibility for your deployment and release processes remains with you. Frost may experience delays or fail to apply protection in edge cases, and you should not rely on Frost as the sole gate against unwanted merges in safety-critical situations.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You acknowledge that Frost provides merge protection as a tool, but the ultimate responsibility for your deployment and release processes remains with you. We are not liable for any code that is merged or deployed, whether during or outside of protection windows, or for any incidents caused or worsened by such merges.

9. Indemnification

You agree to indemnify and hold harmless Infinitlab and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

10. Intellectual Property

The Service, including its design, features, and content, is owned by Infinitlab and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Termination

You may stop using the Service at any time by uninstalling the Frost GitHub App and cancelling any active paid subscription through GitHub Marketplace. We reserve the right to suspend or terminate your access to the Service for violation of these Terms or applicable law, with or without notice.

Upon termination, the data deletion timeline described in our Privacy Policy applies.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, providing additional notice. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
